TERMS AND CONDITIONS OF USE (TCU)

 

1. – Definitions – Concepts

Kanguro Point. These are all locations where packages may be deposited and picked up by carriers and kanguro users. A list of the Kanguro Points agreed with the PREMISES is set out in Annex 1 to this Agreement. New Kanguro Points may be added upon acceptance by KANGURO.

Carrier/Dispatcher/Transport Operator (TO): Natural or legal person or entity in charge of transporting the package, either for a shipment or for a return.

Users: Persona física, jurídica o entidad, registrada en KANGURO, a la que se le debe entregar un paquete procedente de un envío, como recoger un paquete procedente de una devolución.

 

2. – Objective

The transport operators with which KANGURO works, will deliver to the ESTABLISHMENT packages containing labels with the coding of each TO and data of senders and recipients. In this way, the ESTABLISHMENT will become a Kanguro Point. Hereinafter the activity carried out by the PREMISES in the context of this contract may be referred to as “the Service” or “the Activity”. 

3. – Ancillary nature of the activity

THE ESTABLISHMENT declares that the activities regulated in the present contract shall be of an ancillary nature, and it shall be obliged to notify KANGURO in the event that such activities cease to be of an ancillary nature in relation to its main activity.

4. – Receipt and custody of packages

The ESTABLISHMENT will be in charge of picking up the packages from the transport operators when they bring packages to its establishment, respecting the usual rules of collection. The ESTABLISHMENT through its Kanguro point app will scan the QR code shown by the delivery person to validate that it is an authorized delivery person for this service, it will only pick up packages if the delivery person has a valid QR code, after the validation of the QR code of the delivery person, the ESTABLECIMINETO will scan all the packages to validate that they are the correct packages to be received, if any package gives an erroneous validation, the ESTABLECIMINETO will not receive the package which will remain the responsibility of the delivery person. In case of picking up a package without using this procedure, it will be considered as a package NOT picked up and the ESTABLISHMENT will be held responsible if this omission has consequences for KANGURO. In case anomalies are observed at the time of receipt (such as damaged packages, missing packages or empty packages) the ESTABLISHMENT will refuse the packages by not scanning such packages. Once the package has been scanned by the ESTABLISHMENT the responsibility for the package becomes the responsibility of the ESTABLISHMENT.

The ESTABLISHMENT is responsible for the safekeeping of the packages until their collection by the user or by the designated carrier in case of returns. In case of loss or deterioration of packages, clause 5 of the General Terms and Conditions (GTC) shall apply.

5. – Delivery of packages to the addressee

The ESTABLISHMENT will be responsible for delivering the packages to the recipients when they arrive at the establishment to pick them up, respecting the usual rules of delivery. The ESTABLISHMENT through its Kanguro point app will scan the QR code shown by the recipient to validate that it is the authorized user for the collection of the package, it will only deliver packages if the recipient has a valid QR code, after the validation of the QR code of the recipient, the ESTABLISHMENT will scan all packages to validate that they are the correct packages to be delivered, if any package gives an erroneous validation, the ESTABLISHMENT will not deliver the package. In case of delivering a package without using this procedure, it will be considered a package NOT delivered and the ESTABLISHMENT will be responsible if this omission has consequences for KANGURO. In case anomalies are observed at the time of delivery (such as damaged packages, missing packages or empty packages) the STORE will not scan and will not deliver the packages and will immediately contact KANGURO to open an incident. If a package is delivered with anomalies, the STORE will be responsible for the package. If the recipient does not accept the package for any reason, the ESTABLISHMENT will not scan the package and will keep it and will return it through the authorized carrier.

6. – Return of packages to the carrier

The ESTABLISHMENT will be responsible for delivering the returned packages to the carriers when they arrive at its establishment to pick them up, respecting the usual rules of return. The ESTABLISHMENT through its Kanguro point app will scan the QR code shown by the carrier to validate that it is the authorized carrier for the collection of the packages, it will only deliver packages if the carrier has a valid QR code, after the validation of the QR code of the carrier, the ESTABLISHIMINETO will scan all the packages to validate that they are the correct packages to deliver, if any package gives a wrong validation, the ESTABLISHIMINETO will not deliver the package. In case of delivering a package without using this procedure, it will be considered a package NOT delivered and the ESTABLISHMENT will be responsible if this omission has consequences for KANGURO. In case anomalies are observed at the time of delivery (such as damaged packages, missing packages or empty packages) the STORE will not scan and will not deliver the packages and will immediately contact KANGURO to open an incident. If a package is delivered with anomalies, the STORE will be responsible for the package. If the carrier does not accept the package for any reason, the ESTABLISHMENT will not scan the package and will immediately contact KANGURO to open an incident.

7. – Unclaimed packages

The Merchant undertakes to return the packages not claimed by the recipients, as soon as it receives the instructions via the kanguro point app and to adhere to the return protocol explained in point 4 of this contract.

8. – Computerized management of deliveries and collections

For the delivery and receipt of parcels under the present contract, the ESTABLISHMENT shall receive and have access to a computer system owned by KANGURO, whose connection is authorized for the purpose of fulfilling the services indicated in the present contract and, in the event of termination or cancellation of the present contract, the ESTABLISHMENT shall lose such access, with nothing to claim from KANGURO.

The ESTABLISHMENT undertakes to maintain KANGURO’s standards regarding the traceability of the packages, so that any reception or delivery is identified by means of the computer system at its disposal.

The obligation of custody of all packages and merchandise delivered to it for shipment is the responsibility of the ESTABLISHMENT.

In the event of a breakdown or malfunction following normal use of the software applications, the ESTABLISHMENT shall immediately inform KANGURO through its Support Department.

9. –  Package ownership.The packages delivered by KANGURO and stored in the premises of the ESTABLISHMENT are the property of their respective senders or addressees, so that the ESTABLISHMENT may not perform any act of disposal on them.
